Terms of service

Products provided by LisaMD PLLC (D.B.A XCell Health) are contingent on availability. We retain the right to enforce quantity restrictions on any order, decline all or a portion of an order, or withdraw prior notice. Should an error occur, we hold the right to rectify the mistake, adjust your order accordingly (including updating the price), or cancel the order and refund any amount charged. The prices of products are subject to change without notice. You bear responsibility for any relevant sales, use, duty, customs, or other governmental taxes, levies, or fees ("Taxes") associated with purchasing products or services through our platform.

If necessary, we will collect applicable Taxes. We will provide an estimate of Taxes to be collected at checkout, except when explicitly stated in writing that a price includes Taxes. The actual Taxes charged may deviate from the amount displayed at checkout due to factors such as differences between processor programs and changes in tax rates. We are not obligated to collect Taxes in all states, and you may need to report and pay Taxes directly if we do not collect them.

Only valid payment methods approved by us may be used to complete a purchase through our platform. You confirm and ensure that you are authorized to use your selected payment method. You authorize us to charge your selected payment method for the total amount of your order (including applicable taxes and shipping and handling fees). If your selected payment method is declined, we will continue processing your charge until the transaction is approved. We and our third-party payment service providers may request and obtain updated payment card information from your payment card issuer, such as updated card numbers and expiration date information when your credit card has expired. If we receive such updated information, you agree that we may update your account information accordingly and use the updated information to process payments for your future purchases and applicable subscription charges (including applicable taxes, shipping, and handling fees). Your payment card issuer may grant you the right to opt out of providing vendors and third-party payment service providers with your updated card information. If you wish to opt out of your payment card's updating service, you should contact your card issuer. We are not responsible for any fees or charges that your bank or payment card issuer may apply. If your bank or card issuer reverses a charge to your payment card, we may bill your account directly and seek payment using another method, such as a mailed statement.

In the event that any products in your order are unavailable, we will charge only the prices, Taxes, and other applicable fees related to the products included in the shipment. When making a purchase through our platform, you may be asked to provide certain information relevant to the transaction, including, without limitation, your payment card number and expiration date, your billing address, your shipping address, your phone number, and/or your email address. By submitting this information, you grant XCell Health the irrevocable, unencumbered, worldwide, and perpetual right to provide such information (and any updated information we receive) to third parties (e.g., payment processing companies, buyers on our platform, sellers on our platform) for the purpose of facilitating the transaction.
